LESBIAN, GAY, BISEXUAL, AND TRANSGENDER EQUALITY

  • Created ability for all consenting gay and straight couples to enter into domestic partnerships, which grants rights and responsibilities similar to marriage. (SB 283; Veto overridden)
  • Added sexual orientation to non-discrimination protections in places of public accommodation. (SB 207; Passed)

PRIVACY

  • Increased protection of Radio Frequency Identification (RFID) information. RFID is an item-tagging technology on items such as credit cards that can be read at a distance, making it possible to gather information without consent. Theft of RFID information is now prohibited. (SB 125; Passed)
  • Prevented the authorization of “red-light” cameras. The original bill was changed to an insurance bill (AB 504) and the issue was not added as an amendment elsewhere.
  • Prevented the implementation of the federal REAL ID in Nevada. (SB 52; Failed)
  • Stopped the “Nevada Patriot Act” which permitted the government to conduct secret searches and seizures of electronic communications without a warrant. (SB 82; Amended to eliminate problems; Passed)

VOTING & ELECTIONS

  • Expanded registration and voting rights for members of the Armed Forces serving overseas and certain other voters who reside outside of the United States. (; Passed)
  • Redefined initiative petition districts to Congressional districts. The old rule required a certain number of voters in 13 of Nevada’s 17 counties to sign an initiative petition before it could be placed on the ballot. This gave some voters more weight than others and violated the Equal Protection guarantee of “one person, one vote.” (AJR 1 & SB 212; Both passed)
  • Prevented requirement to show proof of identification to vote. (SB 315; Failed)
  • Stopped a bad omnibus elections bill that severely ratcheted up criminal penalties, lowered reporting requirements of donations, and required registration before donating to candidates. (AB 82; Failed)

FREE SPEECH

  • Prevented prohibition of demonstrations near a funeral or a memorial service. (AB 1; Failed)

DUE PROCESS

  • Prevented the formation of an elder abuse registry that contained no due process or appeal provisions for individuals included in the registry. (AB 8; Failed)
Added critical due process protections to problematic bills that:
  • restricted an individual’s right to own a firearm (AB 46; Passed);
  • allowed anyone who possessed child pornography to be sued by victim (AB 88, Passed);
  • redefined the crime of stalking (AB 309; To Governor); and
  • regulated the licensure of massage therapists (SB 119; Passed).

CRIMINAL JUSTICE

  • Made post-conviction DNA analysis more available to people convicted of felonies. (AB 179; Passed)
  • Stopped felonization of repeat misdemeanor criminal “gang” behavior. (AB 335; Amended, Passed)
  • Prevented drastic increase in penalties for cultivation of marijuana plants, including medical patients who grow too many plants. (SB 262; Failed)
RACIAL PROFILING
  • Stopped unconstitutionally vague texting while driving provisions. (SB 136 & SB 309; Both failed)
  • Prevented implementation of a primary seatbelt law, which would allow police to stop any individual for not wearing a seatbelt. (SB 116; Failed)
