LAS VEGAS – The American Civil Liberties Union of Nevada released the following statement following today’s U.S. Supreme Court ruling in Trump v. Barbara.

Trump v. Barbara is a nationwide class action brought by the American Civil Liberties Union, ACLU of New Hampshire, ACLU of Maine, ACLU of Massachusetts, Legal Defense Fund, Asian Law Caucus, and the Democracy Defenders Fund on behalf of children who would be denied citizenship under an executive order issued by President Trump hours into his second term.

In its decision, the court held that children born in the United States to parents unlawfully or temporarily present are “subject to the jurisdiction” of the United States and are citizens at birth under the Fourteenth Amendment’s Citizenship Clause.

“Many Nevadans are going to breathe easier today with the knowledge that the Supreme Court struck down President Trump’s attack on birthright citizenship once and for all. Wins like this are hard to come by, but the ACLU was made to fight, and the ACLU brought forth and argued this case because it was critical to the preservation of society and our Constitution. We will not allow any politician to simply erode our constitutional rights via executive order, including that of citizenship plainly guaranteed by the Constitution. As we continue to lead the nation and state in challenging civil liberties and civil rights abuses, we will continue to move forward aggressively, not simply because these fights are right, but because they are absolutely necessary."
