A student doesn’t lose the right to freedom of belief when he or she steps in school. Personal religious expression is protected from government interference through the Free Exercise Clause. Schools, as formative institutions, possess an affirmative obligation to not only adhere to these constitutional principles but also to cultivate respect for their practice.

The Business of Love in Nevada

It’s Valentine’s Day and it seems appropriate to write about the business of love in Nevada. Just as the holiday has a more complicated history than a card company’s campaign, (there is the feast day of the Christian St. Valentine and the ancient pagan fertility festival Lupercalia) so too is one’s wedding day more complicated than just saying “I do.”

Challenge to Nevada's Religious Test to Perform Marriages

Nevada requires individuals who perform marriages to be affiliated with a religious organization. The people who do not have to be affiliated with a religion in order to perform marriages are certain government officials, including judges and justices of the peace, but they are limited in the number of marriages they can perform each year. On March 27, 2011, the ACLU of Nevada filed suit to challenge the constitutionality of this religious-affiliation requirement.
