ACLU-NV Applauds Decision to Pull Unconstitutional Immigration Initiative Petition

The ACLU of Nevada applauds Assemblyman Chad Christensen’s decision to withdraw the “Nevada Immigration Verification” initiative petition. The initiative petition failed to meet the threshold requirements for a ballot initiative and failed to notify voters of its expansive effects, which stretched far beyond immigration and did far more than Arizona’s controversial immigration law.

-Nevada Challenge Update

The proposed Nevada ballot initiative that would bring portions of the contentious Arizona S.B. 1070 immigration law to Nevada may be on its last legs.

Jones Vargas, a Las Vegas law firm has filed a complaint with the Nevada secretary of state on Tuesday alleging that the initiative’s ballot advocacy group (BAG) has not provided a valid address for its resident agent, a violation of Nevada law.

ACLU of Nevada Condemns Arizona’s Immigration Enforcement Bill and Urges Nevada NOT to Follow Suit

By allowing police officers to stop, question and detain individuals for not having proper identification, Arizona’s new immigration law, SB 1070, drastically expands police powers. It allows for racial profiling in a way that violates the Constitution. It effectively turns Arizona into a police state and turns the principle of innocent until proven guilty on its head by requiring people to have their papers on them at all times. Many innocent people will be stopped by officers, and it puts all Arizonans’ civil liberties at risk.

Effective Legal Counsel for ALL

It’s a great day for civil rights! In a 7-2 ruling, the U.S. Supreme Court just declared that criminal attorneys MUST advise their non-citizen clients about the immigration consequences of a guilty plea. In a society that is supposed to require effective legal counsel for those accused of crimes, this just makes sense. Here’s some expert analysis from ACLU of Nevada board member and local immigration attorney, Peter Ashman:

ACLU of Nevada Disappointed by Metro's Decision to Re-Sign 287(g) Agreement

On October 19, Metro announced its decision to renew its 287(g) Agreement with ICE. The ACLU of Nevada is disappointed by this decision and are additionally concerned that the new agreement reduces record keeping and public accountability.
